This privacy policy applies to simpmatch.com, driverhero.co.uk and workerhero.com and to websites, apps, information and services associated with them. Excluded from this are online services where it is stated that a different privacy policy applies.

We process personal data from you within the framework of the website, among other things, as follows (for further data processing, please refer to the following paragraphs of this privacy policy):

Log files when visiting the website

When using our website, our hosting provider logs so-called "log file" data each time the server is accessed, such as the name of the website accessed, the page previously visited ("referrer" URL), product and version information of the browser and operating system used, requesting provider, date and time of access, search engines used, country of access, amount of data transferred, names of downloaded files and IP address.

The legal basis for the processing is Art. 6 para. 1 f) of the German Data Protection Regulation ("DSGVO"). Our legitimate interest in storing the log file data is to ensure system security, including the detection of misuse. The IP addresses are deleted after a maximum of 7 days, unless they are needed longer due to a security-related incident, e.g. for clarification or evidence purposes.

Contact requests

In the case of contact inquiries, we process your personal data such as name, address, e-mail address, telephone number or similar, which we need to respond to your inquiry.

The legal basis for the processing of your personal data in the context of contact requests is Art. 6 para. 1 b) DSGVO.

In the context of contact inquiries, we store your personal data for as long as it is necessary to process your inquiry, plus a reasonable retention period for queries.

The provision of this personal data is not required by law or contract or necessary for the conclusion of a contract. However, if you do not provide us with this data, we will not be able to respond to your contact request or - in the case of restricted contact details - not be able to respond to all requested communication channels.

Registration/ Orders:

When you register or place an order, we process your personal data such as name, address, e-mail address, telephone number, date of birth, user name you have chosen yourself, payment data or similar, which we require for the fulfillment of the contractual relationship with you or for the implementation of pre-contractual measures that are carried out at your request.

We store your personal data collected in the context of registrations or orders for as long as it is necessary for the fulfillment of the contractual relationship (including, among other things, the provision of the user account and/or our commission settlement with the job provider) and/or for the implementation of pre-contractual measures taken at your request and/or with regard to warranty, guarantee or comparable obligations and/or with regard to statutory retention periods.

Legal bases for the processing of your personal data collected in the context of registrations or orders are Art. 6 para. 1 b) and Art. 6 para. 1 c) DSGVO.

The provision of this personal data is not required by law or contract. However, it is required for the conclusion of the contract, i.e. the execution of the registration or order, insofar as the relevant information in our registration/order process is mandatory (instead of only voluntary).

Consent to the processing of applicant data

When posting applicant profiles on the platform, we process your personal data such as name, address, e-mail address, application documents, etc., which are required for the placement.

The following personal data of your applicant profile is generally viewable for registered job holders on the platform:

  •            First and last name

On the other hand, we only show your name and contact details to those job providers for whom you separately agree to disclosure as part of the placement process on the platform.

The legal basis for the processing of your personal data in the context of the mediation is your consent pursuant to Art. 6 para. 1 a) or Art. 6 para. 1 b) DSGVO ("performance of contract").

With your registration you agree that your mentioned data will be stored for the above mentioned purposes. At the same time, you agree that your data will be stored for the purpose of maintaining your user account and will not be deleted upon successful placement.

You always have the option of updating your personal data and changing your access password in the customer area. If you wish, there is of course also the possibility to delete your previously stored data.

We store your applicant data for as long as it is required for the placement process (including maintenance of your user account and/or settlement of our commission compensation with the job provider), plus a follow-up period of four months.

You can revoke your consent to the processing of your data at any time with effect for the future. We will then no longer process your data for the purpose stated when it was collected. Processing carried out on the basis of your consent before your revocation remains lawful. Mandatory legal provisions - in particular retention periods - remain unaffected.

Newsletter

If you register for our newsletter, we process the data collected in the process, such as your e-mail address, salutation, etc., for the purposes of sending the newsletter.

The legal basis for the processing of your personal data in the context of sending our newsletter is Art. 6 para. 1 a) DSGVO.

We are legally obligated to transmit data to state authorities, e.g. tax authorities, social insurance carriers, health insurance companies, supervisory authorities and law enforcement agencies.

d) the disclosure is necessary in accordance with Art. 6 (1) f) DSGVO for the protection of legitimate business interests, as well as for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

e) in accordance with Art. 28 DSGVO, we use external service providers, so-called order processors, who have been obligated to handle your data with care.

We delete private messages that you send to us via social networks after 2 years have passed since the last communication with you. Public posts from you (e.g. in our timeline) we keep published permanently until you explicitly request their deletion.

We have no influence on which data is collected and transmitted by the operator of the social network, to which third-party recipients a transmission by the operator of the social network takes place and how long the data is stored by the operator of the social network. In this regard, we refer to the privacy policy of the respective social network.

We reserve the right to delete illegal content published by users on our profile page on the respective social network, e.g. copyright infringements or criminally relevant statements.
